11.1. Remainder continues in force: If any provisionor part of a provision of these Terms is invalid or unenforceable, it is severed and the remainder continues in force, including with whatever modifications are necessary to give effect to the commercial intention of the parties.
11.2. Waiver in writing: A waiver of any right under these Terms is only effective if it is in writing and it applies only to the party to whom the waiver is addressed, and to the circumstances for which it is given. A failure to exercise a right is not a waiver.
12.1. These Terms, together with any other terms and conditions relating to the provision of goods or services published on our website (www.moredent.com.au) from time to time which hereby forms part of these Terms by reference, govern the relationship between you and us in relation to the Tool.

Clauses 15 to 21 apply to your use of the implant simulation tool. They are to be read in addition to clauses 1 to 13 of these Terms, and to the extent of any inconsistency these clauses 1 to 13 shall apply in relation to the use of the website, and clauses 15 to 21 shall apply in relation to the use of the implant simulation tool.
15.1. Visualisation Aid: The Tool on the website is a visualisation and marketing tool designed to generate simulated images of potential dental outcomes using artificial intelligence the results of which is downloadable as a jpg (the “simulation”). It is for illustrative or visualisation purposes only and does not constitute medical advice.
15.2. Not a Treatment Plan: Any image generated by the Tool does not constitute a clinical treatment plan, medical advice, or a diagnosis. It is generated automatically and has not been reviewed by a qualified health professional prior to display. It must not be relied upon as a substitute for professional medical advice.
15.3. Your Acknowledgment: You acknowledge and agree that:
15.4. No Guarantee of Result: MoreDent does not guarantee that the results from the simulation can be achieved in reality. The simulation is an artistic approximation produced for illustrative purposes only.
16.1. Image Processing:
16.2. AI Integration: By using this Tool, you acknowledge that image data is transmitted to a third party for processing. While MoreDent utilizes secure transmission protocols, we are not liable for the data handling practices of third-party artificial intelligence providers.
16.3. Patient Information (Name, Email, Mobile, Postcode): You acknowledge that the Tool captures your name, email address, mobile phone number, and postcode (“personal information”) in the course of using the Tool.
16.4. Use of information: You acknowledge that MoreDent may in its absolute discretion use your personal information, uploaded images, the simulation, and any other information stored as a result of using the Tool for any lawful purpose. Without limitation, this includes use for clinical education, marketing and user follow-up. You agree and acknowledge the use may include providing your personal and other information to a third party and may result in us or a third party contacting you for the purposes of discussing your simulation and making suggestions for you in relation to the simulation.
18.1. Ownership: MoreDent retains all ownership rights, title, and interest in the software, interface, and underlying code, and any other intellectual property created by or for us or by the Tool in the course of developing, upgrading, or the use of, the Tool.
18.2. The jpg image: The jpg image generated by the Tool is licensed to you on an on-exclusive basis for your own use. You may store a copy locally or provide it to your qualified dental professional.
19.1. This clause is in addition to and does not in any way limit clause 7 of these Terms.
19.2. MoreDent is not liable for any indirect, special, incidental, or consequential damages (including loss of data, loss of profits, or business interruption) arising out of or in relation to the use of the Tool, or any omission in respect of the use of the Tool.
19.3. MoreDent’s total liability for any claim arising out of or relating to the Tool is limited to the amount you paid to access the Tool (if any) or the resupply of the services.
19.4. Tool provided “as available”: the Tool is provided as available and we do not warrant uninterrupted or error-free operation, accuracy of visualisations, or fitness for a particular purpose. MoreDent is not liable for errors, "hallucinations," or anatomical impossibilities generated by the AI model.
You agree to indemnify and hold harmless MoreDent, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:
MoreDent reserves the right to modify, suspend, or discontinue the Tool (temporarily or permanently) at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Tool.
